Amending the U.S. Constitution

The Constitution is considered as the fundamental law of the land. This holds true because it lays down the basic laws that govern governmental activities. It also provides the rights that every citizen enjoys. In addition, it serves as a guide in the policy-making of the government. Historical accounts reveal that certain provisions in the Constitution become necessary depending on the acts of the government. Through time, demands also change, and in meeting these demands, the need for change arises. Thus, the Constitution allows itself to expand by virtue of ratification or amendment.This has been inculcated in Article V of the Constitution which states the amendment process. Constitutional Amendment Procedure In amending the Constitution, the proposal has to undergo a tough and strenuous process. By virtue of Article V, Constitutional amendment can be done in two ways and requires the process of proposal and ratification. The first way of amending the Constitution is through a pro posal emanating from the Congress. When Congress wants to make amendment, the proposal shall be approved by a two- thirds vote of each house of the Congress (Oatman 9).If the required vote was met, the proposal will be sent to the states for ratification (Oatman 9). In the state legislature, a vote of three- fourths of the states is required for the proposed amendment to be ratified. The second way of amending the Constitution is through a proposal coming from the states (Oatman 9). In this method, two- thirds of the states need to agree on Constitutional amendment. When the required number is met, the states will request for Congress to setup a Constitution Convention where an amendment will be proposed (Vile 1).Three- fourths of the states in the convention must ratify the proposal before it becomes part of the Constitution. During this process, the Congress specifies either to do it through legislature or through special ratifying conventions (Vile 1). In any of the processes, an y state should not be deprived of their right to equal representation, unless they have consented to it (Vile 1). From the Constitutional amendment processes provided, it can be inferred that such entails majority and strong common agreement on the proposal.In addition, in each process, the federal government plays a vital role. Thus, the Constitution itself is federal in nature (Vile 1). Reasons for Establishing the Methods for Amending the Constitution Prevention of abuse of power is one among the reasons for adopting the above stated procedures. When Article V was being deliberated in Congress, George Mason perceived that abuse of power may result if the consent or the power to propose amendment be left alone with the Congress (Labunski 127).On the other hand, if the power to propose is granted to the states alone, they may also abuse their power, and Congress will have no way to interfere. Thus, the deliberation ended with participation of both federal and state legislature. Ano ther reason is the prevention of other amendment processes that involve violence and chance which happened during the British era (Vile 2). Through the processes recognized by the Constitution, any proposed amendment will have to pass an â€Å"an easy, regular and Constitutional way† (Vile 2).Thus, the established Constitutional amendment was meant to preclude abuse, violence, and by chance procedure in amending the Constitution. Successful Amendments: The 13th Amendment Among the successful and popular proposed amendment is 13th Amendment which states: â€Å"Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction† (â€Å"Constitutional Amendments†).The said amendment further states: â€Å"Congress shall have power to enforce this article by appropriate legislation† (â€Å"Constitutional Amendments†) . The amendment was proposed on January 31, 1865 and was ratified on December 6, 1865 by both North and South states of America (â€Å"Constitutional Amendments†). The impact of the amendment was overwhelming as it was as useful tool in eradicating slavery in the country. Moreover, it grants the Congress to legislate laws to enforce the first part of the amendment.Unsuccessful Proposed Amendments: ERA There are also several proposals which did not pass ratification, such as the â€Å"Equal Rights Amendment† or ERA which was intended to establish equality of men and women (â€Å"Constitutional Amendments†). Despite its zealous purpose, the proposal was not ratified because the number of states that approved it was not met before the deadline, even if it has been extended (â€Å"Constitutional Amendments†). It seems that several states were unwilling to express equality among men and women in the Constitution.Perhaps, the proposal failed because of its impe nding threat to the dominance of men. Based on the above stated, it can be clearly concluded that amending the Constitution is not an easy task. Moreover, Constitutional amendment entails the participation of all levels, from state to federal government, because of the public interest that proposals raise. Furthermore, the required vote is abundant enough to strongly establish the willingness of the majority. Conclusion The process of amending the Constitution is not an easy task, nor is the process simple.A state that wishes to make amendments passes a strenuous procedure which starts from petitioning the Congress for a convention to ratification. The convention will not be formed if the states fail to meet the required number of states. On the other hand, the Congress, voting separately, has to meet also the required number in order to make proposals. The Congress then passes the proposals to the states for ratification. The roads were full of chaos, with no traffic lights, and the gas lines were insanely long. I was very fortunate to only loose my power and cable, in comparison to some people loosing a loved one. This hurricane caused approximately $20 billion in damages, which is nothing compared the 19 lives it took. I learned to never underestimate the effects of a hurricane, always be prepared for a hurricane, and to always think and help the less fortunate. Hurricane Charley wasnt perceived as a very powerful hurricane to a lot of people as it progressed more towards Central Florida. I feel that a lot of people were not very prepared for Charley, just as I wasnt. When I heard about this hurricane coming I thought, Oh, another hurricane coming, there is going to be a lot of rain. I didnt think it was going to be a big deal at all. After the hurricane hit, I realized that I was completely wrong. One should always be prepared for a hurricane. I think that this statement is most definitely true, and should be carried out by everyone. Every household should have plenty of water, money, gas, batteries, flashlights, and many other things stashed away in their houses. There were major gas outages at the gas stations, because people were filling up their generators and cars. One of the major problems was that almost everyone was out of power, so you could cook or keep things cold without a generator. This lead to everyone needed ice to keep their very expensive groceries cold. When I looked back at what resulted from Charley, I actually feel fortunate. Yes, Charley did cause my dad lost business, left a lot of yard for me, left power and cable outages, and hundreds of dollars of meat to go bad. When I thought about this I felt kind of unfortunate but, when I thought about the people that starve day after day on normal bases in places like Africa, I feel fortunate. A lot of people in other countries dont ever have power, cable, or even houses for that matter. I think that after events like this,  we should all pull together and help one another. Volunteer to help your neighbors and people that had it worse then you, have free barbeques with your meat that is going to go bad anyway, and most of all give everyone moral support. I think that Charley was a very important learning experience for a lot of us and should be thought about in different views. If you think about it, were you that effected by hurricane Charley? After reading the novel, the reader is left with a multitude of sensations that amount to a feeling of awe at the masterpiece they haven just read. The novel succeeds as an amazing adventure of a group of schoolboys stranded on an island, having to fight to survive an escaping from a terrible Beast. It is difficult to read a page of the novel without wondering what tragic events will unfold next. Golding does not relent in the constant flashes of action and description even at the calm beginning of the novel, when the reader studies the book with a feeling of interest and intrigue as they wonder how the boys will respond to their own island. On another level, Golding brilliantly depicts the boys swift decline into savagery. Golding seems to make astounding observations on what makes humans different human and provides profound description on the way a civilized human becomes a mere savage. Golding seems to suggest that Human characteristics come from the influence of society and civilization and when removed from society, refined humans transcend into barbarians. Civilization is a main theme in the novel. Golding also uses symbolism and metaphors to make statements on the potential and the success of different factors of society. Golding chooses an island as the setting for an island because he wishes to create a microcosm of the world. The novel also relies on the boys being left to their own devices, without the intervention of adults. Golding chooses a group of children rather than adults because children represent innocence and they are also unchanged by society much like humankind was when it first started life on earth. Different types of society are represented on the island. There are two boys fighting for power on the island Ralph and Jack. They represent democracy and totalitarian dictatorship respectively. Ralph aims to lead the island fairly- through voting. He is elected by a vote just like a democratic election. Where as jack rebels against the others, disobeying Ralphs authority and starting his own tribe. Ralph makes rules but doesnt physically enforce them- he wants people to do what he likes but he really bases his rules on the wants and needs of others. Jack on the other hand, makes his tribe do exactly what he wants. He is a complete despot. Ultimately, neither tribe succeeds on the island. The message that Golding seems to be given to the reader is that no society can succeed on earth- democracy is no form of government because it is based almost entirely the wants of the people and the country, therefore is actually being run by the people and not the government. Totalitarianism and fascism are an effective form of government as the country is being run entirely by those in power but ultimately the people will rebel, as they are not getting what they want. This is another profound and intelligent opinion that makes the Lord of the Flies such an excellent novel. The Novel seems to be essentially a book about power and the struggle between Ralph and jack but also the struggle between good and evil. Golding implies that all people have good and evil within them. The boys start off as innocent, good people. From an early point in the novel, the boys fear a Beast. There is actually no physical Beast but as the messianic figure- Simon says, Maybe its only us. In the novel Simon is entirely correct. The boys simply fear the evil that they capable of throughout the beginning of the novel the boys seem to want to hide from, or fight the beast showing that are against evil. Later in the novel, Jack attempts to appease The Beast proving that he has become evil. The subject of religion permeates the whole of the novel. The theme of good vs. evil in the novel ties in with the religious theme. Simon seems to be a messianic, Christ-like figure. Several biblical moments appear to have been recreated within the novel. The island itself represents the Garden of Eden. The beast on the island represents evil but also the Devil. Jacks tribe reverts to a form of devil worship towards the end of the novel. Simon is the one who mainly confronts the beast; Simons meeting with the beast represents Jesus temptation by the devil, in the bible. In short, I first tried to make him sympathize with the plight of the black race and I believe I was successful in doing so. Moreover, I also told him that since he is an Asian, he too, can also be discriminated against. After our conversation, my friend agreed me with and told me that he would be careful with his perceptions about the black race from now on. The music was sad and dramatic and that shot personally made me cry because I can really feel the pain of the tragedy that just occurred. A scene that sends a message through editing is when the black Hollywood director and his wife were stopped by the white police officer. The white police officer molests his wife and that hurts the couple in many ways. They both become very affected by what happened. Later on in the film the wife gets into a car accident where her car flipped over and gets stuck but needs to get out of the car before it explodes. That event became a turning point in the white officer’s life and changed him. He became the opposite of the man that was introduced to us. This editing plays an important role because it shows us that the same person who hurt us would be the same person that is there in your time of need. The editing used in this film definitely portrays the theme. The techniques used show that all the major events that happened in their lives were caused by each other. Basically, criticism of an employer’s practices about wages, hours and working conditions is protected no matter how it is expressed, as long as it is ‘protected, concerted activity.’ The NLRA says that â€Å"protected† is any statement about wages, hours or working conditions, and â€Å"concerted† means the employee’s statements were engaged in with or on the authority of other employees. Workers need to be aware that statements made through this type of forum have to be directed to other employees or to the company on behalf of the employees – not just personal gripes. However, employers need to understand that it doesn’t matter where or even how the employee makes these statements as long as it is â€Å"protected† and â€Å"concerted†. As popular social media sites like Facebook and Twitter continue to influence the way co-workers communicate on the job and outside the workplace, companies feel they do have the right to legally monitor their employees’ activities online, in order to ensure a most professional and lawsuit-proof workplace. â€Å"Bosses can penalize employees for what they deem as â€Å"inappropriate† post, videos and pictures on social-networking sites, even if a worker uses those sites during non-working hours†, states Lewis Maltby, author of the workplace rights book, Can They Do That? Though the most frequently cited justification for workplace monitoring is to prevent employee theft, sabotage, and violent incidents on the job, companies have also voiced concerns that they run huge risks with employees leaking â€Å"trade secrets† or other confidential and proprietary information about their people, products, and services to outside competitors online. In his book, The Naked Employee, author Frederick Lane, a workplace expert on the impact of technology and society, points out â€Å"employers are increasingly more interested in hiring employees who will not expose the company to additional costs and liability, while not hiring employees who will increase their cost through negligence, misconduct, and wrongdoing† (28). But the biggest threat companies are now beginning to fear is the line between an honest online discussion that may lead to defamation of a company, which can be blurry in certain situations, making it even more difficult to distinguish the truth. Although computers have revolutionized employees’ workplaces in ways that earlier generations could not have imagined, U. S. companies, such as retail giant Wal-Mart, may realize they are in catch-up mode with modern technology, due to new challenges brought on by the recent explosion of social media sites. The NLRB found that employers facing this growing trend need to establish social media policies that do not infringe on workers’ rights. For example, the NLRB learned that one company mandated it’s employees to stay away from controversial topics such as religion and politics, and adopt a professional tone in the use of their social media, while other companies had gone so far as to blatantly forbid their employees from posting anything potentially misleading about the company online, and even told their employees to be careful about â€Å"friending† other co-workers on Facebook. The Washington Times reported that in June of this year along, â€Å"the NLRB also found that six of the seven corporate social media policies it examined included provisions that failed to pass regulatory muster, proving to be too vague or intrusive on their workers’ rights to free expression online.† NLRB General Counsel, Lafe Solomon, cited other companies, including DIS H Network and Target, have also maintained similar corporate social media policies that at least partially violated provisions of the NLRA. This delicate balance became strikingly apparent in a recent case filed with the NLRB by a non-union employee fired from a non-unionized emergency medical response team. The employee filed a charge with the NLRB against the company for wrongful discharge after losing her job for posting negative comments about her boss on Facebook. According to the employer, the posting violated a company policy that prohibits employees from making negative remarks on the Internet about the company or its employees. However, the employee claimed that the policy and her discharge from the company violated the NLRA by denying employees their right to engage in the protected, concerted activity of sharing complaints about working conditions with fellow workers. The case settled before an actual hearing with the company agreeing to revise its policy to eliminate any social media restrictions on its employees that could be in violation of the NLRA. In the initial complaint against the company, the NLRB cl aimed the employer’s policy was overly broad and prohibited employees from writing personal personal depictions of the company online without permission or posting any disapproving comments. Cases such as these should serve as a reminder to every employer that the NLRA applies to unionized and non-unionized workers alike. But in this increasingly technologically savvy world, the larger questions looming for both employers and employees alike should be what are the boundaries of an employee’s privacy, and who is more entitled to draw that line. â€Å"Companies should protect themselves and their employees by setting clear expectations on proper social media use in the office,† says Dean Debnam, CEO of Workplace Options, a public policy polling company that surveys American workers. â€Å"However, employers must be cautious of how far they take these regulations. While social media polices are not a problem, survey results show that employees do not support any intrusive measures, such as demanding access to passwords.† As new avenues of self expression created by social media and newly developed technologies evolve, employees should definitely be mindful as to what constitutes a legitimate basis for termination. Companies’ rights to dismiss employees at will, unless that is some statute, like the Labor Act, prohibits a particular act of retaliation, should not be taken lightly. In this tough economy where companies feel that image is still everything, even applicants who have applied for jobs may find out later they have been denied employment, due to messages communicated to their friends on social networking sites they thought were private and password protected. The bigger notion that’s scary for some employees is that once you are hired, you may find that your employer has taken drastic steps to make sure that access to your privacy extends well beyond company working hours. Lane agrees that workplace monitoring is a major problem, because â€Å"technology makes it possible for employers to gather enormous amounts of data about employees, and often goes far beyond what is necessary to satisfy safety or productivity concerns (3-4). Few rights are as deeply treasured by American citizens as their freedom of speech. As the Internet and social media sites becomes more mainstream within the workplace, employers must find better ways to draft and implement employment policies that protect the company from things such as legal disputes and charges of discrimination, while at the same time making sure employee’s rights under the NLRA and other federal employment laws are protected and preserved.
